Terms of Service

Welcome to AmenityResy, a platform operated by Dibsly LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website and mobile application (the "Service"). By creating an account or using the Service, you ("User" or "Resident") agree to be bound by these Terms.

1. The Service

AmenityResy is a scheduling and management platform for building amenities. We provide the software to facilitate bookings; we do not own, manage, or maintain the physical spaces (gyms, pools, etc.) where these amenities are located.

2. Resident Disclosure & Liability Waiver

BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE TO THE FOLLOWING:

  • Software Only: AmenityResy is a scheduling platform only. Dibsly LLC is not responsible for the condition, safety, or cleanliness of any physical amenities.
  • Assumption of Risk: Use of building amenities carries inherent risks (e.g., slipping, equipment failure). You voluntarily assume all risks associated with the use of these spaces.
  • Waiver of Liability: To the maximum extent permitted by law, you release Dibsly LLC and its officers from any and all claims for personal injury, property damage, or death arising from your use of physical building amenities or any disputes with other residents over bookings.
  • Code of Conduct: You agree to follow all building rules set by your Property Management. We reserve the right to suspend your access for misuse of the booking system.

3. Account Eligibility

You must be a resident or authorized user of a building that has an active contract with AmenityResy. You are responsible for maintaining the confidentiality of your login credentials.

4. Subscription & Payments

  • For Residents: Access is typically provided through your building management. If any fees are charged directly through the app, they are non-refundable unless otherwise stated.
  • For Property Managers: Use of the platform is governed by the specific Service Agreement signed between your organization and Dibsly LLC.

5. Prohibited Conduct

Users agree not to:

  • Use "bots" or automated scripts to hoard or "snipe" booking times.
  • Reverse-engineer or attempt to extract the source code of the Service.
  • Use the Service to harass other residents or building staff.

6. Data Privacy & Compliance

Our collection and use of your data are governed by our Privacy Policy. We comply with the NYC Tenant Data Privacy Act (TDPA) and other applicable laws. We will delete or anonymize your personal data within 90 days of being notified that you have terminated your account or moved out of the building.

7. Limitation of Liability

To the maximum extent permitted by law, Dibsly LLC's total liability for any claim arising out of these Terms shall not exceed the amount paid by the user to Dibsly LLC in the twelve (12) months preceding the claim. We provide the Service "As-Is" without any warranty of 100% uptime or availability.

8. Dispute Resolution & Arbitration

Any disputes arising from these Terms will be resolved through:

  • Informal Negotiations: Parties agree to attempt to resolve disputes informally for 30 days.
  • Binding Arbitration: If unresolved, disputes will be settled by binding arbitration in Montgomery County, Maryland, under the rules of the American Arbitration Association (AAA).
  • Class Action Waiver: You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any purported class action.

9. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws principles.

10. Updates to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification at least 30 days before the changes take effect.
